Terms and Conditions

When a customer purchases a product from Noah Garden Rooms, the customer is agreeing to the terms and conditions as set out below. Customers are advised to read the following terms and conditions carefully. Our terms and conditions do not affect your statutory rights.

Our details and contact

Our contact details are available on our website – www.noahgardenrooms.co.uk. Telephone calls to and from our office are recorded. When payments are made over the telephone, we will put you on a secure line which is not recorded.

Placing your order

Please note that most of our buildings do not require Permitted Development checks with your local council. Our standard buildings are produced to a maximum height of 2.5m, which does not require Permitted Development checks if on flat level ground. If your building base is elevated or you have a canopy roof as part of your building, it is your responsibility to check with your local council to see if this falls into Permitted Development. Noah Garden Rooms Ltd is not responsible for this check or any issues that arise if you have not contacted your local council. As a guide, a building can be a maximum of 2.5m from the ground if within 2m of a boundary and 3m from the ground if more than 2m from a border. A dual-pitched roof can go up to a maximum of 4m if more than 2m from a boundary. In both cases, the maximum eaves height is 2.5m from the ground. Any building larger than 30m² will require planning permission. The building cannot take up more than 50% of the curtilage (garden area), including any other outbuilding present. This guide applies to England only. If you live in Wales or Scotland, please check with your local authority.

When placing an order, we will send a confirmation of order which will confirm all the details of your building. You have 14 days from placing the order to make any amendments. It is the customer’s responsibility to check that the details, including cost, measurements, and specifications, are correct. These are usually sent via email but can be posted on request. All buildings are made to order. If your building layout differs from that shown on the website, we will ask for a sketch. If you want windows or doors in specific places, we require clear measurements on the drawing to avoid confusion. Otherwise, we will position these as deemed best based on your drawing or description. We will also provide an estimated delivery date upon ordering.

Approximately four weeks before the estimated date, we will confirm a specific delivery date. We will make every effort to deliver on that date. If we cannot due to unforeseen circumstances (e.g. breakdowns, strikes, material shortages, sickness), you will be informed as soon as possible and a new date will be given. No compensation is due if we are unable to deliver due to these factors. All prices include VAT. A 25% deposit is required upon ordering. 10% of the total cost is a non-refundable deposit. Any ordered upgrades are also non-refundable, even if removed later.

Cancellation period and fees

At least 21 days’ notice is required for cancellations or postponements of buildings without upgrades. Failure to provide this notice may result in a fee up to the full building cost. If you confirm your order within the 21-day period, this notice applies immediately. For upgraded buildings, you may be charged even with more than 21 days’ notice if items had to be ordered in advance. Changing from fitting to delivery-only or collection within the 21-day period will forfeit any fitting charge refund. Cancelling before 21 days incurs a 10% fee of the standard cost plus the cost of any upgrades.

Base preparation and access

Erection can only take place if the base is solid, level, and of sufficient size. Gravel or moving hardcore is not suitable. The base should match the building’s size exactly. If larger, additional waterproofing may be required. A concrete base should be 4–6 inches deep and allowed to cure for at least seven days. Bearers usually run the length of the building; if using a timber base, bearers should run the width. Please contact the office for the floorplan if using a timber frame. We recommend 4″x2″ timber minimum. Contact us for advice if unsure.

We are not responsible for checking the base level. Inadequate bases may result in buildings being left stacked on-site, and a return visit will incur a charge. Access must be clear, with 8ft height and 3ft width minimum. If access is angled, allow at least 8ft 3” for diagonal clearance. We will not carry buildings over walls, garages, or fences. Difficult terrain and sharp corners may restrict delivery. Carrying through a house is not allowed. If assistance is required, please have 2–4 people on-site. Smaller panels are available for a fee. Standard carry distance is 100ft; contact us for longer distances. A 1ft clearance around the base and 8ft vertical access is required, including overhead clearance.

Notify us of access issues in advance. If you’re unsure, contact us and send photos and measurements. We are not responsible for any access or groundwork problems not previously disclosed. Payment is required upon delivery. For delivery-only, the building is delivered kerbside. At least two people are needed to move it into the property. For collections, the customer must bring a suitable vehicle and two people to load. If not, we may refuse collection or charge £120 per person if assistance is available. Planning permission checks are the customer’s responsibility.

Delivery and installation

Delivery is arranged for mutual convenience. We operate across England and Wales, so delivery times are estimates only. Our fitters may provide a courtesy call when possible. Customers must ensure someone is present to accept delivery. Failure to meet delivery arrangements may incur reattendance fees. Once installation begins, the building cannot be repositioned. We are not responsible for accidental damage during delivery/fitting. Collection customers must inspect each panel before the driver leaves.

Electrics

We sub-contract electrical work to qualified electricians. If we cannot install due to issues not caused by us, return charges apply and the original fee is non-refundable. Cancellations within 48 hours of electrical installation incur a £200 fee.

Completion of order

Once completed, the customer or representative must inspect the building. Any issues must be noted on the delivery ticket. If no notes are made, we consider the job satisfactorily completed. If no one is present, this is deemed a breach of contract, and any post-completion issues will be the customer’s responsibility. We will take pictures of the completed building.

Faults, shortages, or defects

Notify us of any defects within seven days via [email protected], including photos. If the fault is ours, we may offer repair or partial refund. We are not liable for consequential losses or earnings.

Product maintenance

Our buildings typically do not require planning permission. Use for alternative purposes should be discussed with local authorities. Wood is natural and may have imperfections such as knots or splits, which do not affect structure. Expansion, shrinkage, and weather-related changes are normal and not defects. These are not grounds for replacements or refunds. Door adjustments may be necessary over time. Felt rippling is not considered a defect. Leaks caused by weather void the three-month felt warranty. Modifying the building also voids this warranty. EPDM rubber roofs and other upgrades are available with warranties. Shingle roofs are not guaranteed against weather damage. Ensure proper ventilation, especially if insulating. Timber sizes quoted are ex-sizes (pre-machining). Specs may change without notice to improve product quality.

10-Year Rot Guarantee

Timber is pressure treated with Tanalith E. This excludes joinery doors/windows unless painted. Guarantee does not cover warping/splitting. To maintain your guarantee:

  • Use a solid, level base.
  • Maintain regular treatment.
  • Do not modify in ways that affect structure or allow water ingress.
  • Maintain a 1ft clearance for access.
  • Avoid contact with walls or trees.

Force Majeure

We are not liable for delays or failures caused by events beyond our control, including natural disasters, war, strikes, or theft.

Additional costs

Cancellations incur fees between 10% and the full order value, depending on timing. If delivery or fitting fails due to customer fault, return fees apply—up to 50% of the order value. Fitting charges are non-refundable if you later self-assemble. Collections without adequate personnel incur a £120 per helper fee (subject to availability).
