UK garden rooms LTD T/A Noah Garden Rooms – Terms and Conditions. 2025.

 When a customer purchases a product from Noah Garden Rooms, the customer is agreeing to the terms and conditions as set out below. Customers are advised to read the following terms and conditions carefully. Please speak with our friendly office if you have any questions.

 Our terms and conditions do not affect your statutory rights.

Our details and contact.

 Our contact details are available on our website: – www.noahgardenrooms.co.uk Telephone calls to and from our office are recorded. When payments are made over the telephone, we will put you on a secure line which is not recorded.

Planning Permission and Permitted Development

Most of our buildings do not require Permitted Development checks with your local council. Our standard buildings are manufactured to a maximum height of 2.5m, which typically does not require checks when installed on flat, level ground.

If your building base is raised/elevated or if you choose a canopy roof, you are responsible for checking with your local council whether this still falls under Permitted Development. UK garden rooms Ltd is not responsible for carrying out these checks or for any issues that arise if you do not confirm this with the council.

General guidance for England:

  • Buildings within 2m of a boundary can be up to 2.5m high.
  • Buildings more than 2m from a boundary can be up to 3m high.
  • Dual-pitched roofs can be up to 4m high if more than 2m from a boundary.
  • Maximum eaves height is 2.5m from the ground in all cases.
  • Any building over 30m² requires planning permission.
  • Outbuildings must not take up more than 50% of the garden area (curtilage), including existing buildings.

This guide applies to England only. If you live in Wales or Scotland, please check with your local authority.


Order Confirmation and Amendments

After you place an order, we will send you an order confirmation listing all details of your building. You have 14 days from the date of ordering to make any changes.

It is the customer’s responsibility to ensure all details—price, measurements, and specifications—are correct. Confirmations are normally emailed, but can be posted if requested.

All buildings are made to order.
For bespoke buildings (e.g., specific door/window placements or exact spacings), we require clear and accurate measurements on your drawing to avoid confusion. If details are not provided, we will position windows and doors where we think is most suitable based on your drawing or description.


Delivery and Installation

When you place your order, we will provide a delivery date and an installation date. Around four weeks before delivery, we will confirm these dates with you.

We will always aim to deliver on the agreed date. However, if we cannot attend due to circumstances beyond our control—such as vehicle breakdowns, strikes, material shortages, sickness, or other unexpected issues—you will be notified as early as possible (either before or on the delivery day). A new delivery date will then be arranged.

No compensation will be offered if we are unable to attend due to these factors.

Pricing, Deposits and Payments

All prices and charges include VAT.

A 25% deposit is required when placing an order.
Of this, 10% of the total building cost is non-refundable.

Any upgrades you add to your building are also non-refundable, as these items are purchased specifically for your order. If you later decide to remove an upgrade, you will still be charged for it.


Cancellation, Changes and Postponements

Within the 14-day cooling-off period

You may change, postpone or cancel your order within 14 days of placing it.

After the 14-day cooling-off period

If you change or postpone your order after the 14 days, we may charge a fee.

Base / Foundations

Important Information Before Installation

The following base requirements apply only if you have NOT purchased a base through Noah.


Ground Screw Base (Installed by Noah)

If you have purchased a ground screw base upgrade from us, the supply and installation of this base is covered by the terms and conditions of that specific ground screw base purchase.


Customer-Supplied Base

Your building can only be erected if the base you provide is:

  • Solid
  • Completely level
  • Large enough (no smaller than the actual building size)

Gravel or loose hardcore that can shift is not considered solid.

Concrete Bases

  • We recommend a depth of 4” to 6”.
  • Allow the concrete to cure for at least 7 days before installation begins.

Timber / Framed Bases

  • Our floor bearers usually run along the short width of the building.
  • If you build a timber framed base, your bearers must run the length of the building.
  • This ensures proper support for the floor sections.

Please contact our office to confirm the floor plan so you know exactly where supports are needed.
It is helpful to have a few spare bearers available in case additional supports are needed where floor sections meet.

For timber framed bases, we strongly recommend:

  • Minimum 4” x 2” timbers
  • Ideally 12” spacing

Base Checks and Installer Requirements

We are not responsible for fully checking the level of your base, and small discrepancies may not be identified during installation. If you have concerns about your base, please contact the office as soon as possible.

If the base or ground is found to be unsuitable:

  • Our fitters will stack the building sections on your property.
  • Fitters cannot wait onsite for any base corrections.
  • It is your responsibility to correct the base.
  • We will return on our next available date to complete the installation.
  • A re-attendance charge will apply (see our additional costs section).
  • We cannot remain onsite while you fix an insufficient base.

Access Requirements

General Access

The customer is responsible for providing suitable access to the installation site.

We deliver using 3.5-ton vans and may sometimes use a trailer, so you must ensure the road and property access are wide enough. We cannot drive over fields to reach your site.

We require:

  • 8 ft height access
  • 3 ft width access to reach your base

If access requires panels to be carried at an angle (because 8 ft height is not available), the diagonal height must be at least 8 ft 3 in to allow for panel thickness. Access must be clear of any obstacles.

We will not carry buildings over walls, fences, hedges, garage roofs, or similar structures. Many panels are large, so please consider sharp corners, steps, slopes, and narrow paths.

We will not carry panels up or down steps unless this has been agreed in advance with the office via email or recorded phone call.
We will also not carry panels through a house or garage.

We allow 30 minutes for you to move panels through your house or around obstacles. We recommend having 2–4 people available to assist.

Panels can be made smaller for difficult access, but this comes with an additional charge.

Please also consider the distance from the delivery vehicle to the base. An average carrying distance is 100 ft. If your carry distance is longer, contact the office to discuss options.


Space Around the Building

When ordering, consider the full dimensions of your building, including roof overhang.

We require:

  • A minimum of 8 ft access to your base
  • 1 ft of space around the base for construction
  • Adequate access above the building for our team to fit the roof coverings

Please check for overhanging trees, branches, or other obstacles.


Reporting Access Issues

Customers must inform us of any potential access difficulties before installation day. Each job has a set time allocation, so these issues must be addressed in advance.

If you are unsure about access, contact the office. We may request photographs and measurements to be emailed to [email protected] for assessment and approval.

We accept no responsibility for on-site inaccuracies outside our control.
Issues such as:

  • Inadequate groundworks
  • Insufficient access
  • Unreported obstructions

will result in additional charges (see Additional Costs section).
Full payment for the building will still be required upon arrival.


Delivery Only

If you choose delivery only, it will be curbside delivery. You must have at least two people available to accept and move the building onto your property.


Customer Collection

If you choose to collect your building, you must bring a suitable vehicle capable of handling the size and weight of the panels.

You (or your chosen courier) must bring two people to load the panels.
If you do not provide two able loaders, we may refuse collection.

If staff are available, we may assist at a cost of £120 per person. If no staff are available, you will need to rearrange your collection.


Planning Permission

We are not responsible for checking planning permission.
It is the customer’s responsibility to confirm any planning requirements before placing an order.

Delivery and Installation

Delivery dates are arranged for the convenience of the company, in agreement with the customer. As we operate across England and Wales, it can be difficult to provide an exact delivery or installation time. We will give an estimated time on request, and our fitters will provide a courtesy call where possible before arrival.

Although we provide estimated times and dates, we cannot guarantee them. Delays may occur due to circumstances beyond our control, and we are not liable for any delay or failure to deliver on the estimated date.

Customers must ensure that someone is present to accept the building on delivery day. It is the customer’s responsibility to ensure arrangements are in place. If the customer does not keep to the agreed arrangements and delivery becomes impossible, we reserve the right to charge a return fee to come back and erect the building. No discount will be given if you later choose to erect the building yourself.

Once installation has begun, the building cannot be repositioned, so please ensure that the exact location is clearly identified before we start.

We are not responsible for accidental damage to your property during delivery or installation.

If delivery only is chosen, delivery will be to the curbside only. You will need at least two people to accept and move the building onto your property.

If a customer chooses to collect their building or arranges their own courier, it is the responsibility of the customer and/or courier to inspect every panel before loading. We accept no responsibility for items damaged in transit or reported as damaged after leaving our premises.


Electrics

We subcontract all electrical work to qualified electricians.

If we are unable to install the building on the booked day through no fault of our own, additional charges will apply for us to return to complete the electrical installation. The original electrical installation fee is non-refundable.

If electrical work is cancelled within 48 hours of the scheduled installation date, a £200 cancellation fee will apply.

Completion of Order

When the building installation is finished, the customer or their representative MUST inspect the building with the installation team.
If there are any issues, these must be pointed out to the installers and written on the delivery ticket before signing.
If no notes are added, we will assume the job has been completed satisfactorily.

If no customer or representative is present at completion, this will be considered a breach of contract by the customer. In this case, once the building is finished, it will be deemed complete and satisfactory.
If any issues arise later with parts or functions that would normally be checked during sign-off, we will not be liable, and it will be the customer’s responsibility to resolve them. Any call-outs after this will be chargeable.

Our team will take photographs & videos of the completed building at the end of installation.

If the building is being delivered only, the customer must inspect each panel for any issues before the driver leaves.

Timber Moisture

Buildings installed during winter months will contain timber with a higher moisture content, especially if installed in wet conditions. Your room may need airing out if installed during rain. In this instance, we recommend leaving doors and windows open when possible to allow ventilation, followed by heating when in use. Please speak to our office if you have any questions.

Ground Screw Bases

For buildings installed on ground screw bases, please refer to our separate Ground Screw Base Terms and Conditions.

Faults, Shortages or Defects

If any parts of your building damaged after installation please highlight to the team At the time of delivery & installation

If you have a complaint, please send In writing within seven days of delivery & installation.

We will always request clear photographs showing the defect so we can determine the cause before arranging any rectification.

If a defect is confirmed and is clearly the fault of UK garden rooms Ltd, we will offer suitable solutions, which may include a repair or a partial refund (at management’s discretion).

We cannot accept any claims for loss of earnings or consequential losses if a return visit is required.

Our Products and Maintenance

All of our buildings are designed so that planning permission is not required in most cases under permitted development. It is the customer’s responsibility to check this for your area, and Noah Garden Rooms accepts no liability if permission is needed but refused.

Our buildings are sold as day use garden rooms that typically do not require permissions or regulations. If you plan to use your building for specialised purposes, you must check with your local council or authority before proceeding.


Natural Properties of Wood

Wood is a natural material and may contain:

  • Knots
  • Splits
  • Resin pockets

These are purely aesthetic and do not affect structural integrity.

Timber naturally reacts to environmental conditions. As a result, you may experience:

  • Colour changes
  • Surface splits or cracks
  • Warping or shrinkage
  • Slight variation in board profiles

These are not defects and are not covered by Noah Garden Rooms for replacement, refunds, or repairs.

The number of panels used may differ from website images due to:

  • Building size
  • Cladding thickness
  • Window/door layout
  • Material availability

For timber cladding, filler may be required if gaps appear through natural expansion and contraction.


Doors, Roofs and Weathering

Door adjustments are not covered under guarantee and may occasionally be needed as would a house PVC or Aluminium door.

EPDM rubber roofing include a 10-year warranty

This warranty is void in the event of a storm or damage from Animals, fireworks etc


Ventilation and Insulation

You must ensure the building is ventilated to prevent moisture/condensation by opening the doors and windows regularly.

If you order a garden building, and plan to board and insulate your building yourself, we recommend:

  • Breathable membrane
  • High quality insulation

Please speak to our sales team before ordering so we can discuss the required upgrades.
Regular ventilation is essential to prevent condensation or mould. We are not liable if mould appears.


Timber Sizes and Materials

Timber sizes can be ex (pre planed) sizes – for example any CLS sizes given before being planed for a smooth finish

Timber characteristics will change over time due to environmental conditions.

We reserve the right to change:

  • Timber species
  • Timber grade
  • Cladding profiles
  • Systems or products

These changes may be made due to market conditions or improvements in design and quality.
Such changes will not affect your existing order or cost.


Timber Cladding and Appearance

If you order a timber cladded building, we recommend painting your building with a waterproofing paint to maintain timber cladding lifespan as soon as possible. You will need to maintain this treatment yearly in line with manufacturer recommendations. We recommend Teknos or Protek paints.

If you choose thermowood cladding, you do not need to paint the cladding unless you want to change the colour.

Thermowood painted cladding upgrade through Noah is pre coated and will have touch ups on site if there are any marks during installation or transit

Website images are for illustration only. Buildings shown may vary in size or design based on customer requests. Colours may also vary slightly due to digital photography, but this does not change quality or performance.

We may use photos of your completed building for marketing or for customer images on our platforms. Please email us if you do not wish for your images to be used.


Specification and Terms Updates

All specifications are correct at the time of ordering but may be changed or withdrawn without notice. We continually improve our design, quality and service, so we may amend products or policies when necessary. This will not affect your placed order.

We reserve the right to update our Terms and Conditions at any time. This does not affect your statutory rights.


10-Year Structural Guarantee

All our buildings come with a 10-year structural guarantee, which covers the main structural framework against defects in materials or workmanship. This guarantee applies only when the building has been installed, maintained and used in accordance with our guidelines. The guarantee does not cover any damage caused by adverse or extreme weather conditions, including but not limited to storms, high winds, flooding or any other environmental events, and will be void in such circumstances. Natural characteristics of timber such as movement, shrinkage, warping, splits or cracks are not considered faults and are therefore not covered. This guarantee does not apply to roofing materials, water ingress caused by insufficient maintenance, or any issues arising from modifications, alterations or additional works carried out by the customer. The guarantee covers structural components only and does not include any consequential loss, damage to personal belongings, or costs associated with labour, re-attendance or remedial works beyond the repair or replacement of the affected structural part.


Tanalised timber cladding-

 Our timber materials are pressure treated and tanalised with Tanalith E. The preservatives protect the wood from attack by termites, other insects, fungal decay and rot for 10 years.


To maintain the validity of the 10-year structural guarantee, the following conditions must be met:

  • The building must be installed on a solid and level base made from a suitable material. If the base is not solid or level, we may offer to install the building under a disclaimer, which will affect your warranty and guarantee, or we may refuse installation and provide the building on a delivery-only basis.
  • The building must receive regular maintenance and treatment (excluding composite buildings).
  • The building must not be modified in any way that could affect its structural integrity or allow moisture ingress.
  • A minimum of 1 foot of clearance must be maintained around the building to allow for ongoing treatment and to prevent moisture build-up.
  • The building must not be in contact with exterior walls, trees or vegetation that could transfer moisture into the timber.

Force Majeure

Force majeure refers to any event or circumstance beyond our control. This includes, but is not limited to: acts of God, war, terrorism, flooding, severe weather, explosions, natural catastrophes, civil or military disturbances, strikes, and theft. We will not be held liable or responsible for any failure or delay in fulfilling our terms and conditions if such failure or delay is caused by a force majeure event.


Additional Costs

If you cancel your order after paying a deposit, a fee will be applied ranging from the non-refundable 10% deposit up to the full value of the building, depending on when the cancellation occurs (see Cancellation Period and Fees section).

If we are unable to deliver or erect your building through no fault of our own, a re-attendance charge will apply. This fee must be paid before we attempt to return. The amount depends on the building size and your distance from our premises and may be up to 50% of the total order value, plus any additional mileage charges.

If you choose our fitting service but fail to provide adequate access or a suitable base, the fitting charge will still apply and is non-refundable. No discount will be given if you later choose to erect the building yourself.

If you are collecting your building and do not provide two people to load the panels, we will charge £120 per person (inc. VAT) for staff assistance, provided staff are available. If no staff are available, collection will not be possible on that date.
